Alibaba is fighting back against the US government in court. The Alibaba lawsuit landed on June 23. It asks a federal court to strike the company from the Pentagon’s Section 1260H list of Chinese military firms. Notably, the Defense Department had only added Alibaba two weeks earlier, on June 8.
What the Pentagon’s list does
The Section 1260H list comes from a 2021 defense law, and the Pentagon updates it every year. Specifically, it names Chinese companies that the department ties to the People’s Liberation Army or to China’s “military-civil fusion” strategy. In this round, the Pentagon also added Baidu and the carmaker BYD, which pushed the roster to 188 firms.
The label carries real weight, too. Once a company lands on the list, the Pentagon cannot buy its products or services, and the ban takes effect on June 30. As a result, other businesses also face pressure to keep their distance or risk US trade restrictions of their own.
Alibaba’s argument
Alibaba rejects the designation outright. According to the company, there is “no basis” for the listing, and it argues the move tramples its free-speech and due-process rights. Alibaba also states plainly that it “is not a Chinese military company nor part of any military-civil fusion strategy.” On top of that, it has promised to “take all available legal action.” Meanwhile, Baidu has pushed back in similar terms.
Why the challenge could stick
History gives Alibaba a real opening. Earlier, Xiaomi faced the same kind of designation, took the Pentagon to court, and won removal from the list. So the precedent suggests these labels are not always permanent.
Still, the stakes reach well beyond one company. This fight also lands during a fragile US-China tech standoff. Washington keeps leaning on Chinese firms, much as it did when a US government order forced Anthropic to pull two models. It also pulls in BYD, the EV giant named on the same list. For now, a court will decide whether the Pentagon’s evidence holds up, or whether Alibaba follows Xiaomi off the roster.
